Upon receipt of any claim, a 30 day demand letter will be sent out immediately. This is followed up with a phone call and a personal visit (if practical). If the debtor does not pay within the 30 day period, or show any movement towards an amicable resolution, we will then send out our recommendation on whether suit should be filed along with our suit requirements. Once the client decides to proceed with suit, there is a two tiered court system in New Jersey depending on the amount of the claim forwarded, the Law Division and the Special Civil Part.

The Special Civil Part is ideal for the processing of collection matters because filing fees are low and the docket moves quickly. In Special Civil Part matters, we request advanced costs of $200.00.

In matters where the balance due exceeds $15,000.00, it is necessary to bring the action in the Law Division. We request advanced costs in the amount of $400.00 for Law Division matters.

If the defendant fails to file a responsive pleading, in either the Special Civil Part or Law Division, a default judgment can be obtained by the filing a Certification with the court. No court appearance would be required by client.

Once a judgment has been entered either by default or after trial, a Writ of Execution is issued. The Court Officer to whom the Writ is assigned has a wide variety of legal options available. The officer can seize bank accounts, make goods and chattels levies and post sale notices. In the case of individual defendants, an application can be made for a Wage Execution, an Order to pay out of wages.

We reserve the right to request a retainer against an hourly billing rate should the defendant interpose a counterclaim against client or the defendant appeals any judgment.
